Day Care Regulations

OCFS has updated Day Care Regulations for the following modalities: Day Care Centers, Group Family Day Care, Family Day Care, Small Day Care, and School Age Child Care
Each modality has its own set of regulations:

Training Requirements
Each FDC provider, assistant, and substitute must complete a minimum of 15 hours of training during their first 6 months of registration (or date of hire). A total of 30 hours must be completed every 2 years.
Each SACC director must complete a minimum of 15 hours of training during their first 6 months of registration. All SACC employees must complete a minimum of 15 hours of training within six months of hire, including an Office-approved training that complies with federal minimum health and safety requirements within three months of hire. A total of 30 hours must be completed every 2 years.
NEW DCC and SACC DIRECTORS
All new Directors of Day Care Centers or School-Age Child Care programs hired on or after October 1, 2017, will be required to complete an OCFS 15-hour health and safety classroom training either pre-service or within 3 months of their start date as Director. In addition, current Directors who have not completed the Foundations in Health and Safety eLearning by September 30, 2017, will also be required to complete the OCFS 15-hour health and safety classroom training. There is a cost associated with this training. The goal of this training is to provide DCC and SACC Directors with information on best practices that lead to high-quality child care.
For all modalities, training must also address all of the following 10 topic areas (SACC employees are exempt from Topic #9).

(3) Child Day Care Program Development
(4) Safety and Security Procedures
(5) Business Record Maintenance & Management
(6) Child Abuse & Maltreatment Identification & Prevention
(7) Statutes & Regulations Pertaining to Child Day Care
(8) Statutes & Regulations Pertaining to Child Abuse and Maltreatment
(9) Education & Information on the Identification, Diagnosis, and Prevention of Shaken Baby Syndrome
(10) Adverse Childhood Experiences, focused on understanding trauma and on nurturing resilience

Mandated Reporter

Mandated reporters are those people who have a job or are in a profession that makes them legally obligated to notify law enforcement or adult/child protective services about a known or suspected risk to children. Mandated reporters must report this information or face the loss of their jobs and professional licenses and/or even criminal and civil liability, i.e., child care providers (for a list of mandated reporters go to www.ocfs.state.ny.us)
